Israel's Knesset voted on Monday to advance a key bill in the governing coalition's judicial overhaul which would abolish Israel's “reasonableness standard,” eliminating the Supreme Court's ability to block government decisions it deems unreasonable.
Following the initial vote, the bill awaits discussion in the Knesset Constitution, Law and Justice Committee, which will be held on Tuesday. The bill must clear two additional Knesset votes to pass into law.
Abolishing the reasonableness standard is regarded as a key component of the Netanyahu-led government's plan to weaken the country's judicial system. Anti-overhaul protest leaders announced that they plan to hold a nationwide day of disruption on Tuesday should the law pass the first vote.
According to critics of the overhaul, cancelling the reasonableness standard will seriously damage the judicial system's ability to reverse extreme acts by the government such as corrupt appointments and dismissals in key posts. It will also limit the court's ability to protect the election process from corruption, and ordinary citizens from arbitrary, illogical administrative decrees.
The bill – an amendment to Israel's Basic Law on the Judiciary – states that “those who have the authority to adjudicate the law, including the Supreme Court sitting as the High Court of Justice, will not judge or issue an order against the cabinet, the prime minister, a minister or any other elected official as determined by law, regarding the reasonableness of their decision.”
The bill that was voted on follows the wording it contained before lawmakers held deliberations on it. During the five meetings of the Constitution, Law and Justice Committee on the bill, not a single change was introduced.
While lawmaker Simcha Rothman, the constitution committee's chair, wishes to stick to the bill's current version as it proceeds through the second and third votes, other coalition members seek to revise the bill to exclude mayors from exemption from the reasonableness standard.
Sources close to Prime Minister Benjamin Netanyahu told Haaretz that the premier himself requested to draft a less inclusive version of the bill, but senior coalition members urge him to approve its current version.
